U Y A R I Genel Seferberlik Hali
07 Ekim 2020Lübnan’da Yüksek (Ulusal) Güvenlik Konseyi’nin talebi üzerine 15/3/2020 tarihinde toplanan Bakanlar Kurulu’ndan sağlık konusunda 29/3/2020 tarihine kadar geçerli olacak “olağanüstü hal” ve “genel seferberlik hali” kararı çıkmıştır.
Buna göre alınan kararlar özet başlıklar halinde aşağıda sunulmaktadır.
- Lübnan’da yaşayan herkes evlerinde kalmaya ve “çok acil durumlar” dışında sokağa çıkmamaya çağrılmaktadır. Çok özel acil durumların ne olduğu ve buna uymayanlara uygulanacak yaptırımların çerçevesi henüz tespit edilmemiştir.
- Kamu ve özel her türlü toplanma/toplantı/etkinlik yasaklanmıştır.
-Beyrut Uluslararası Havaalanı dahil olmak üzere ülkeye kara-deniz-hava giriş çıkış noktaları 18 Mart Çarşamba gününden 29 Mart Pazar gecesine kadar yolculara kapatılacaktır. BM’ye ait UNIFIL, diplomatik misyonlar, uluslararası kuruluşlar, 4 no’lu deniz sahasındaki sondaj faaliyeti, kargo uçakları personeli kapsam dışındadır.
- Ülke dışında yaşayan Lübnan Vatandaşları veya oturma izni bulunan kişiler, virüs testlerinin negatif çıkması şartı ile 18 Mart tarihine kadar ülkeye girebileceklerdir. Bu uygulama her halükarda daha önce seyahat yasağı getirilen ekte sayılan ülkelerden gelecek kişileri kapsamamaktadır: Fransa, Mısır, Suriye, Irak, Almanya, İspanya, Birleşik Krallık, İtalya, İran, ÇHC (Tayvan dahil) ve Güney Kore.
- Tüm kamu kurumları, idareler, belediyeler, üniversiteler, özel ve devlet okulları ile kreşlerin faaliyetleri 17-29 Mart tarihleri arasında durdurulmuştur. Bu uygulamaya Savunma Bakanlığı ile Sağlık Bakanlığı personeli için istisna getirilmiştir. Benzer şekilde Elektrik İdaresi de hizmetlerin devamını teminen istisna kapsamına dahil edilmiştir.
Bakanlar kurulu öncesinde bankalar birliği tarafından ay sonuna kadar tüm bankaların faaliyetlerini durduracağı açıklanmış ise de, hükümet tarafından bankaların anılan dönem süresince kapalı kalması uygun görülmemiş konu hakkında bugün içinde (16/3/2020) karar verilmesi öngörülmüştür.
- Fırınlar, gıda ve tüketim malları satışı yapanlar hariç tüm ticari işletmeler ve mağazaların aynı dönem zarfınca faaliyetleri durdurulmuştur. Bu kurala sadece meslek kuruşları ile istişare halinde özel acil durumlar için istisna tanınabilecektir.
- Hükümet aynı zamanda güvenlik teşkilatına bu kararlara uyulması için gerekli tedbirleri alma yetkisi vermiştir. Aynı zamanda Dışişleri Bakanlığı, Sağlık Bakanlığı ile irtibat halinde olarak ülkedeki büyükelçilikler ve uluslararası kuruşlar nezdinde ülkenin ihtiyaç duyduğu sağlık malzemesi ve ilaç temini için gerekli girişimlerde bulunmakla görevlendirilmiştir.
-Özellikle corona virüs ile mücadelede kullanılabilecek her türlü tıbbi malzeme, sağlık araç gereci ve ilaç iki ay süreyle her türlü vergiden muaf olarak ithal edilebilecektir.
Bu aşamada; mal sirkülasyonuna dair resmi herhangi bir kısıtlama bulunmadığı bilinmekle birlikte, gümrük idaresi ile yapılan görüşmelerden idarenin genel tedbirler gereği personel indirimine gittiği gıda, sağlık ürünleri gibi ürünlere öncelik verileceği, temel tüketime dair olanlar dışında kalan malların ise gümrüklerde işlem görmesinin zaman alacağı bilgisi edinilmiştir.

The Lebanese government decided at its emergency session on the Corona virus:
First: Announcing the general mobilization from the issuance of this decision on March 15, 2020 until midnight March 29, 2020, to implement the following plans:
1. Emphasizing on the obligation of citizens to remain in their homes and not leave them except for the extreme necessity of the negative impact that leads to the spread of the epidemic.
2. Emphasis on all decisions taken to confront the Corona virus regarding preventing gatherings in different public and private places, as well as on travel to and from Lebanon from some countries, with follow-up depending on the development of conditions in the countries concerned with these procedures and in other countries.
3. The closure of Rafic Hariri International Airport and all air, sea and land ports (only in front of expatriates in relation to land and sea ports) from Wednesday, March 18, 2020 until twenty-fourth of Sunday on March 29, 2020, with the exception of UNIFIL and diplomatic missions Accredited in Lebanon, international organizations, cargo planes and people working for companies associated with drilling operations in Block No. 4.
4. Allow the Lebanese, and their family members who do not have a Lebanese identity or do not have residency cards, as well as those who hold residency cards in Lebanon, to return to Lebanon until the date of March 18, 2020 implicitly and provided that the result of the PCR is negative (laboratory examination of Corona) and that it does not include within this decision whom comes from countries to which travel has already been banned, to which are the following: France, Egypt, Syria, Iraq, Germany, Spain, United Kingdom, Italy, Iran, China (Hong Kong, Macao, Chinese Taiwan) and South Korea.
5. Closing of public departments, institutions, municipalities and their unions, independent departments, universities, public and private schools, and nurseries, in all their different forms, with the exception of this:
• What is required by the necessities of work in ministries, public administrations, public institutions, municipalities and their unions according to a mechanism issued by decisions of the ministers or of the authority that has authority, under penalty of responsibility for those who violate those decisions.
• The main institutions of the Ministry of National Defense, the General Directorate of Internal Security Forces, the General Directorate of General Security, the General Directorate of State Security, the General Directorate of Civil Defense, members of the municipal police, municipal guards, and firefighting teams of different kinds.
• The Ministry of Public Health, hospitals, government and private clinics, non-governmental organizations (NGO), social welfare centers, and everything related to the health sector in the hospital, pharmaceutical and laboratory fields and their manufacture, while providing all the requirements of this sector of materials, equipment and needs.
• The General Directorate of Social Security and the General Directorate of the Cooperative of State Employees, mutual support funds, insurance companies, health monitors, auditors and the TPA, in relation to hospital, health, pharmaceutical and laboratory approvals.
• Rafic Hariri International Airport management and management of all air, sea and land ports.
• The Lebanon Electricity Corporation and all other institutions and companies that are responsible for securing and distributing electric current in all Lebanese regions, with everything related to production, nutrition and distribution.
• The General Directorate of Oil at the Ministry of Energy and the Department of Oil Installations, with everything related to securing fuels and related accessories, storage and distribution, including fuel stations, companies and institutions that undertake the import, storage and distribution of gas.
• The General Directorate for Water Resources and Water Institutions, the National Authority for the Litani River and the General Directorate for Investment, in relation to water insurance, storage and distribution, and the companies and private institutions that handle the mobilization and distribution of water.
• The Banque du Liban and all banks, in coordination with the Association of Banks in Lebanon, the companies and institutions for the transfer and distribution of funds and banking institutions, with the minimum required to secure the requirements for the daily operation of their business.
Second: Suspending work in different companies, institutions, and commercial stores, and the offices of self-employed, taking into account the extreme necessity associated with working conditions in coordination with the unions of these free professions. Excludes mills, bakeries, and everything related to manufacturing, storing and selling food and other basic consumables, agricultural products and raw materials needed for them. Also excluded are companies and institutions working in the field of transporting goods by air, land and sea.
Third: The authorities, public administrations, public institutions, municipalities, their unions, and all military and security services, each according to its competence, shall be charged with carrying out the legal requirement to implement the above immediately.
Fourth: Applied instructions are issued for the plans outlined above, and for the special provisions covered by Article Two of the amended Decree No. 102/1983 amended, according to decisions issued by the Prime Minister based on the proposal of the competent minister and include the time periods for the validity of those plans and special provisions.
Fifth: It is exempt from customs duties and the internal consumption fee, and for a period of two months from the date of this decision, the import of medical, hospital and laboratory supplies and equipment exclusively used for the prevention of corona virus and treatment of cases of infection in it, in addition to accepting donations /gifts that include it. It also assigns the Minister of Public Health, in coordination with the concerned ministers, to define it.
Sixth: The Minister of Foreign Affairs and Expatriates, in coordination with the Minister of Public Health, is charged with making the necessary contacts with the embassies of countries and regional and international organizations to provide Lebanon with medical, hospital, laboratory, and pharmaceutical requirements in accordance with donations and / or in-kind or material assistance.
Seventh: The Minister of Information and the National Media Council are mandated, in coordination with the Ministry of Public Health and the two heads of doctors in Beirut and Tripoli, to coordinate with all media outlets regarding programs and investigations related to the Corona virus and how to deal with it.
Eighth: The Ministry of Finance shall be charged, when necessary, with securing the necessary funds to cover the expenses of implementing what is stated in the body of this decision.
Ninth: The Ministry of Justice is tasked with preparing the necessary texts to suspend legal, judicial, administrative and contractual deadlines as of October 18, 2019.
